Terms of Service
Like all decent business-type websites, we need a little ol’ terms and conditions notice for you to accept before you purchase a custom trip planning package from ONE ADVENTURE AWAY, LLC (OAA). I know most people skip past these and just click “accept” but let’s be honest, this is hilarious, so I encourage you to pour yourself something strong, sit back, and enjoy the comedy. Oh also, it’s a legally binding agreement so like, there’s that.
By purchasing package trip planning services offered by OAA, the customer accepts these Terms of Service.
TRIP PLANS
OAA will provide as accurate, up-to-date, custom trip plans suited to individual or group needs as possible. The level of detail provided depends on the package the customer has purchased. The traveler understands that OAA will sometimes create custom itineraries for locations to which OAA trip planners have not personally traveled. The traveler understands that recommendations are often the result of research as opposed to first-hand experience.
TRAVEL BOOKING
OAA will never book travel or on-the-ground reservations for a provided plan for any reason. The traveler is responsible for all bookings, including airlines, on-the-ground transportation, meals, and any museums or sites of interest outlined in the OAA custom trip plan.
VENDOR CHANGES
In the event that a vendor (hotel, site, transportation, museum, etc.) changes its hours of operation or ceases operation in a way that differs from an OAA custom trip plan, OAA will not be held responsible for these changes. Vendor changes are entirely out of OAA’s control.
PAYMENT
Payment is due in full prior to the start date of the traveler’s OAA custom trip plan start date.
REFUNDS
OAA’s custom trip plans are non-refundable. OAA does not provide refunds, as OAA is not responsible for whether the traveler uses an OAA custom trip plan.
CREDIT/DEBIT CHARGEBACK POLICY
If you are not happy with the trip plan OAA has provided to you, you agree not to file a chargeback with your credit or debit card company before you have given us an opportunity to address the matter. By signing this agreement, you agree to work with us in good faith to resolve your dispute and acknowledge that chargebacks are not an appropriate way to avoid our refund and cancellation policies.
ALTERATIONS
OAA may provide on-the-ground alterations to your trip plan on a case-by-case basis for a negotiated additional fee. The logistics of being available to travelers while in Europe and OAA are state side are difficult to manage, so we can’t promise anything. But depending on your need, we’ll do our best to accommodate you.
INSURANCE
OAA does not provide trip insurance, but we are happy to recommend trip insurance to travelers who ask for it. We recommend every traveler purchase trip insurance, but do not require it for service.
FORCE MAJEURE
OAA will not be deemed in breach of this agreement or otherwise liable to you, by reason of delay in performance or non-performance of any of its obligations under this agreement to the extent that any such delay or non-performance is due to any Force Majeure. “Force Majeure” means any circumstances beyond our reasonable control, including without limitation acts of God, terrorist activities, insurrection, explosion, flood, tempest, forceful wind, typhoon, fire or accident, war or threat of war declared or undeclared, sabotage, civil disturbance, labor strikes, requisition, sickness, quarantine, pandemic, epidemic, diseases and viruses that are known, unknown or novel such as coronavirus/Covid-19 (including any spread thereof), foodborne, airborne, and communicable illnesses and disease, government intervention of any kind that affect domestic and/or international travel, government restrictions or warnings, diplomatic or health organization (e.g., World Health Organization) warnings, border closings, weather conditions, and unforeseen circumstances.
In the uncommon situation where Force Majeure prevents, significantly hinders, or makes it impossible for OAA to provide agreed-upon custom trip plans, we shall be entitled to, in our sole and absolute discretion, take one or more of the following steps: cancel, alter, modify, postpone, or reschedule any trip plan.
You understand and agree that we will not be able to pay you any compensation, costs, or expenses you incur as a result of Force Majeure. We regret that no refunds will be provided if we take any of the preceding actions due to Force Majeure. If OAA is affected by Force Majeure, it, if practicable, will notify you of the nature and extent thereof.
DISCOUNTS AND PROMOTIONS
All discounts and reduced pricing are offered and or applied at OAA’s sole discretion. From time-to-time, OAA may offer reduced pricing on selected trip plans. The reduced pricing applies strictly to new plans only. Plans for which the traveler has already paid are locked into their original price and are not entitled to the reduced pricing.
PASSPORTS AND VISAS
The traveler is responsible for ensuring that all necessary travel documents are valid and effective and in your possession for the entire trip. Valid passports are required for travel to most destinations. Please check with the appropriate consulate or embassy for the latest entry requirements. The traveler assumes complete and full responsibility for, and hereby release OAA from any duty of, checking and verifying any and all passport, visa, vaccination, or other entry requirements of each destination, and all safety or security conditions at such destinations. Any information provided to you is merely provided as a courtesy and it is your sole responsibility to ensure you have met all travel requirements for each destination in your itinerary. OAA is not responsible for delays, changes, or cancellation costs due to incorrect, incomplete or expired traveler documents. In the event that you must cancel, delay or reschedule your trip due to expired or missing travel documentation, you are responsible for all associated costs to rectify the situation. If you are unable to take your trip, you will not be reimbursed or refunded any amounts as per the refund terms listed in this document.
We recommend that U.S. citizens register for the U.S. government’s Smart Traveler Enrollment Program, a free service.
LIMITS ON RESPONSIBILITY
At no point, and under no circumstances, is OAA responsible for payments or costs relating to external services such as flights, accommodations, services, car service, or any other part of travel that was booked and paid for externally to OAA.
TRAVEL ADVISORIES & WARNINGS
Knowledge about any travel advisories and warnings issued by government authorities for the country or countries visited by the traveler on an OAA custom trip plan is the traveler’s responsibility. In the U.S., you must consult the U.S. State Department’s website at www.travel.state.gov or contact them by phone at the number specified on their website. You are responsible for protecting your own well-being and personal property before, during, and after the travel outlined on an OAA custom trip plan. This includes ensuring any and all vaccinations, inoculations, or prescribed medications are taken as directed by your local doctor and/or travel clinic for the areas visited.
TRAVEL DOCUMENTS
You will be solely responsible for obtaining and retaining any and all travel documents necessary for the travels outlined in an OAA custom itinerary.
LIMITATION OF REMEDIES
To the maximum extent permitted under applicable law, OAA shall not be liable for any special, consequential, indirect, incidental or other damages arising out of or in any way connected to this agreement, including lost profits, whether such damages arise in contract, negligence, tort, under statute, in equity, at law, or otherwise, even if OAA has been advised of the possibility of such damages. You expressly waive any right you may have to recover such damages.
GOVERNING LAW
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Washington, without regards to conflicts of laws principles.
TRAVEL AT YOUR OWN RISK
You agree that your participation in any portion of the OAA custom trip plan is entirely voluntary and done at your own risk. You further agree that OAA shall not be liable for any damage, loss, or injury that might result from your participation in any portion of the OAA custom trip plan.
UPDATING OF TERMS AND CONDITIONS
We may on occasion amend these Terms and reserve the right to update or alter these Terms at any time. Any amendment will take effect seven days after being posted to our website, immediately upon notice to you in writing by email or mail. An up-to-date hard copy of these Terms will be sent to you upon your written request. You are deemed to have accepted any amendments to these Terms on the date that is seven days after their posting on our website or immediately upon notice to you in writing by email or mail. We recommend that you refer to these Terms prior to travel to familiarize yourself with the most up-to-date version available.
